Well, well, here it is, December. Wow, time sure does fly by when you are having fun. And I know many of you are having fun!!! I thought overall the ESP dinner at the Hooked Seafood and Martini Bar went well. Yes, there were some issues, however I believe everyone in attendance had a great time. Once again I would like to thank Joan, Kathy, Lisa, Sharon and Susan for an outstanding job. For the record they are planning for next year and working out the bugs. I would like to thank the ladies from the High School for behaving this year. (Side joke!) (Also for the ladies from the high school, I am looking into the possibility of tampering with the ticket drawing. It sure seems suspicious that we had the majority of winners from one corner of the room.)
I have been somewhat busy working along with Joe Kirk of DSEA on issues within the District. We are receiving some major concerns, which I am hoping will lead to a future contract upgrades. At this point I would like to thank the building reps. These Support Staff reps are great! As issues arrive to their attention, they try to nip it at the bud. When the issues seem to be too big, then they contact me, in which I contact Joe. This is what the Cape Henlopen Support Staff is all about.
Bus drivers/ monitors, I still want to hear from you on our upcoming breakfast. Don’t forget the meeting on Jan. 9, 2014 at Grotto’s Pizza. I will be contacting you.
As we come into the Winter Break I hope that you all have a wonderfully time with your families. And never forget the reason for the season.
As I close this newsletter please check out the attachment. As we are coming into the flu season, there are many ways to prevent the spreading of germs. This little booklet, “The Stomach Bug Book”, is from the NEA. I believe it has information for everyone of us. Sometimes we seem to get lost into the world and forget some of the simplest things.

November 2013 Newsletter
I apologize, this is a very lengthy newsletter, please take the time to read the information. Thank You!
Once again, the Support Staff remains busy. Members are either calling or sending emails to their building reps or myself on issues of concerns. Keep them coming. This is what we do!
Last week, Monday November 4, I had the opportunity to attend a Sussex County DSEA local meeting with Dom Zaffora of DSEA. The entire DSEA locals within Sussex County were invited. I met with other presidents and we discussed issues. I found it amazing how much each of the locals has in common!
Thursday November 7 we held our monthly executive meeting. Some of the topics that we discussed were the upcoming ESP Dinner at the Hooked Seafood and Martini Bar on November 20, 2013. Also a major concern to me and the support staff is the lack of communication with Bus Drivers. This past weekend, I called 11 bus drivers. One of my goals is to establish a bridge of communication with the drivers on their concerns. I have suggest on having a meeting after their morning runs.
This month’s newsletter I would like to inform the support staff on the Weingarten Rights. Now you may ask, “What in the world is he talking about?”
I believe that every support staff member should be aware of this!
Weingarten rights apply during investigatory interviews when a supervisor is questioning an employee to obtain information that could be used as grounds for discipline. When an employee believes such a meeting may lead to discipline, he/she has the right to request union representation.
These basic Weingarten rights stem from the Supreme Court’s decision:
1. The employee must request representation before or during the meeting.
2. After an employee makes the request, the supervisor has these choices:
a. grant the request and wait for the union representative’s arrival;
b. deny the request and end the meeting immediately; or
c. give the employee the choice of either ending the meeting or continuing without representation.
3. If the supervisor denies the request and continues to ask questions, the employee has a right to refuse to answer. In addition, the supervisor is committing an unfair labor practice.
HISTORY
Almost thirty years ago a counter clerk who worked for a J. Weingarten store in Houston, Texas, was questioned by her Employer for alleged theft. Although she was cleared in the investigation, she had been denied, after several requests, the presence of her Shop Steward during the questioning.
The Union representing her filed an unfair labor practice after the incident and, in the case NLRB v. J. Weingarten Inc., 1975, the Supreme Court ruled in the Union’s favor. An important new right for workers emerged from this decision: In the U.S. Supreme Court declared that unionized employees have the right to have a steward present during a meeting with management when the employee believes the meeting might lead to disciplinary action being taken against him/her. This case applies to workers in the private sector. Most public employees have similar rights, but the rules vary from state to state, so check your state’s labor laws.
Employee Rights in “Weingarten” Meetings
Beware that management is not obligated to inform employees of their Weingarten rights - employees must ask for them. Unlike Miranda rights - where police are required to tell a suspect of his/her right to an attorney, etc. - employees must ask for their Weingarten rights.
Some locals provide members with a wallet-sized card they can keep with them. If they find themselves in a meeting they believe may lead to discipline, they can read or hand the card to the supervisor.
Steward Rights in “Weingarten” Meetings
• Ask to be informed of the purpose of the meeting.
• Meet with the employee before the supervisor begins questioning the employee.
• If necessary, request clarification of a question before the employee responds.
• Offer advice to the employee on how to answer a question.
• Provide additional information to the supervisor after the meeting is over.
If called in to a “Weingarten” meeting, you should also: 1) take detailed notes on the questions asked and the answers given during the meeting; and 2) help the employee remain calm during the meeting, and remind the employee to keep answers short and truthful and not volunteer additional information.
Below is an example of a Weingarten Card. I would advice each member to print this out and cut this sample card!!!!

If the discussion in this meeting could in any way lead to my being disciplined or terminated or impact on my personal working conditions, I request that my steward, local officer or union representative be present. Without union representation, I choose not to answer any further questions at this time.”

Q: Can I have a Shop Steward present at any meeting I have with Management?
A: No, only when you have a reasonable belief that discipline will result from an investigatory meeting.
Q: What is an investigatory interview?
A: An investigatory interview occurs when a supervisor questions an employee to obtain information which could be used as a basis for discipline or asks an employee to defend his or her conduct.
Q: Is Management obligated to remind me of my Weingarten rights prior to an investigatory meeting?
A: No, you must request a Steward’s presence. Management has no obligation to remind you of your right.
Q: What if I’m told to be in my Supervisor’s office at 10am but I do not know the nature of the meeting?
A: You have the right to know beforehand what the subject of the discussion will be. And, you have the right to consult (caucus) with your Steward before and during the meeting.
Q: What if a routine work meeting is taking place between my Supervisor and me, but the nature of the meeting suddenly changes?
A: You have the right to stop the meeting and call in a Steward at the point you believe you are being asked questions which could result in discipline. You cannot be punished for requesting a Steward’s presence.
Q: If I request a Steward, does the Employer have to comply?
A: The Employer must choose from among three options:
1. Grant the request and delay questioning until the Steward arrives and has a chance to consult privately with the employee; or
2. Deny the request and end the interview immediately; or
3. Give the employee a choice of having the interview without representation.
Q: What is the role of a Steward in an investigatory meeting?
A:
1. When a Steward arrives, the Supervisor must inform him/her of the subject matter of the interview, i.e. the type of action/misconduct for which discipline is being considered.
2. The Steward must be allowed a private pre-interview conference before the questioning begins.
3. The Steward must be allowed to speak during the interview.
4. The Steward can give advice on how the employee should answer questions.
Q: What if a Supervisor denies my request for a Steward?
A: If you are denied a steward’s presence and are still asked questions, the Employer commits an unfair labor practice and the employee has a right to refuse to answer. The supervisor cannot discipline the employee for such a refusal.
The following information is taken from DSEA Calendar that was handed out in 2012-2013.
Please follow the advice of DSEA!!!!!!!
1. Do not resign or abandon your work location.
2. Document, in writing, the incident.
3. Keep any records that relate to the incident.
4. Representation is strongly advised. You have a right to representation: “If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working conditions, I respectfully request that my Association representative be present at the meeting. Without representation, I choose not to answer any question.”
5. Timeliness is important – don’t delay.
6. Use your contract as a guide. (I WILL SEND A COPY SEPRATE)
7. Follow orders unless there is potential for personal injury – you can grieve the orders later.
8. Call your UniServ Director (Joe Kirk) for help. All communication with your Association is strictly confidential.

I had the privilege, along with Amanda Jester of CHEA, to attend a DSEA training seminar at the Branch Office located in Newark DE. The seminar focused on the role of the narrative in organizing DSEA membership with special emphasis on the nuts and bolts of the one-on-one conversation. The guest speaker was Michael Gecan, he is the organizer extraordinaire who shared his years of experience and valuable insight with us. His topic was ‘BUILD: Guidelines for Effective Individual Meetings’. Which lead into a discussion on “What Leaders Really Do”. I will say it was fantastic! I had the opportunity to speak with Fredericka Jenner (it didn’t hurt that I sat across from her and picked her brain) on some of the concerns here at the Cape Henlopen District, pertaining to the Support Staff. She promised me that she will stay in touch with the Support Staff. Also I had a very enlighten discussion with Michael Hoffman about the para’s. (I believe Michael once served on the Cape Support Staff years ago). I spoke to various presidents and vice-presidents on issues that they may have, which paralleled the same concerns as us. I had a discussion with Christen, who is one of the lobbyist for DSEA on custodian units and maybe there should be a look into changing the format on this. Overall I believed the time spent with the DSEA personnel was very informative, not only for me, but also the future of the Cape Henlopen Support Staff.
I have some really good news; Deb Paxton has contacted me and said she would like to become the Secretary for the Support Staff. THANK YOU DEB!!!!!!
Also Cindy McMahon at the High School said she would be willing to help Roger as a building rep. THANK YOU CINDY!!!!!

October 3, 2013 CHSSA Board Meeting @CHHS
Tim welcomed and thanked those in attendance for their continued support.
Those in attendance were: Donna Schirmer (MMS), Jeannie Morris (Shields), Susan Krause (RES), Kathleen Law (RES), Tarra Kennedy (BMS), Sharon Sherwood (Treasurer), Julie Wilson (MES), Tim Eitner (President)
Treasurer's Report: Sharon Sherwood presented the budget and a motion to approve the budget was given by Susan Krause and seconded by Kathleen Law.
Susan Krause and Kathleen Law presented and discussed the bids for the Membership Dinner to be held November 20, 2013. The bids were from Jake's Restaurant, Bethany Blues and Hooked Seafood and Martini Bar.
Joan Williamson had sent an email to the CHSSA representatives on September 26th detailing the bids and Hooked Seafood and Martini Bar was selected for this year's Membership Diner by a large margin. All Building Reps will get a flier to post in their buildings and all RSVPs are due by November 13th. (This date was modified due to the Veterans' Day Holiday to Friday, November 8th.)
If 80-90 RSVPs are received the restaurant will be closed to the membership only. The menu is $20 per person with gratuity included and is as follows:
A 50/50 Raffle will be run at the Dinner. One or two drawings from the pot are yet to be decided. Joan Williamson is to be asked to be in charge of Door Prizes and Susan Krause offered to be one of the greeters at the door to keep a tally of all attendees.
Bus Drivers and Consortium are to be notified of the dinner and all membership issues via Office Mail.
Lisa Ingram is to be contacted in references to New Membership and Current Dues. Mary Beth D'Amico is to be contacted in reference to Membership Shirts.
Kathleen Law offered to sed a Sample Membership Card out to Building Reps to they know how to instruct the new members in the application process.
As of September 9th, 2013 Membership Dues was as follows:

October 1, 2013 Contract Ratification!
As some of you may know by now the members ratified the Support Staff Contract on Wednesday September 25, 2013. Then on Thursday September 26, 2013, the School Board gave their approval. On Friday September 27, 2013, Mary Beth and myself signed the contract on behalf of the Support Staff.
While I was with Cathy P. in her office I asked her if she knew how the retro pay would be made. Cathy called Oliver G. on this. Oliver told us that the retro pay would be in the October 18, 2013 paycheck.
I would like again to thank the negotiation committee for their hard work.

Welcome: Seventy five members signed in for this
meeting. Tim Eitner introduced himself as our new President and welcomed
everyone and thanked them for their support and attendance. He introduced the rest of the board; Lisa
Thorp, Vice President, Sharon Sherwood, Treasurer. He let all know that we need a secretary,
anyone willing or able to donate and hour a month please consider supporting
your local this way. He thanked all
past board members for their time and dedication to the support staff. Tim advised that he can be reached at tim.eitner@cape.k12.de.us He
also explained he hopes to establish contact with all members not only through
their Cape email addresses but their personal email addresses. He also has plans for a monthly newsletter.
DSEA
Representative: Tim introduced Joe Kirk to everyone and
explained that at anytime members were to feel welcome to contact Joe with
questions they might have. Joe advised
that there were three issues that the members need to discuss before we leave

Ed welcomed everyone present, and thanked all for their
support of him over the last years, he has enjoyed working with all. Those present were Kathy Law, Susan Krause,
Sharon Sherwood, Tim Eitner, Joe Kirk, Donna Schirmer, Joan Williamson, Mary
Beth D’Amico, Ed Murauskus.
Negotiations
- We have been bargaining for 15 months.
The Teachers union is near to ratifying their contract, but CHSSA is
not. There are 3 issues that are
separating us from agreement. The three
issues in contention are;
1. D.O. wants a 4 year contract, CHSSA is asking
for a 3year contract. CHSSA has
determined it was not to our benefit to bargain at the same time as the
teachers and if we agree to a 4 year contract we will be back at the table the
same time as they are,
2. DO does not want
to give 12 month employees spring break, CHSSA is asking for it,
3. D.O. is unwilling to upgrade the Senior Secretaries in
each building to financial secretary which is what we are asking for. It is
uncertain when the two groups will be meeting again.

welcomed and thanked everyone present for their support and attendance, and
expressed his wish that everyone will continue to support the new board. Those able to attend were; Ed, Lisa Thorp,
Lisa Ingram, Joan Williamson, Mary Beth D’Amico, Pat Bishop, Joe Kirk, Tim
Eitner, Tarra Kennedy, Donna Schirmer, Molly Siple, Janet Graviet, Jeannie
Morris, and Debbie Gaudlip. All schools
had representation!
Negotiations - CHSSA will meet
again with the District Office on May 6th. So far the DO is offering increase in pay of
1%, 1%, and 2% - with a 3 year contract.
The DO has explained that these increase amounts must be adhered to so
that we can keep our benefits intact. Winter break will still be discussed,
especially since the DO extended it. Our
contract expired June 30th, 2012.
A new contract will be retroactive to that date.

Negotiations:
CHSSA bargaining team will meet on March 21st with the DO.
Election
Year: Ed reminded everyone that all officers’
positions - President, Vice President, Secretary, and Treasurer are open for
nominations, and will be vacant if not filled.
Please stress the importance of keeping our local staffed to support our
cause. Pat Bishop has volunteered to be
nominating chair and will get the ballots out to all building reps by the April
10th meeting, and then she will come to the May 1st
meeting to count the returned ballots.

not interested in running again. Please

members informed.
